By creating an account or using Fleito, you agree to these terms and to our Privacy Policy and Refund and Cancellation Policy. If you do not agree, please do not use Fleito.
1. What Fleito is
Fleito is software for businesses that rent electric vehicles to riders ("operators"). Operators use Fleito to manage their hubs, vehicles, riders, payments and maintenance. Riders use the Fleito Rider app to join an operator, complete verification, sign their rental agreement, pay what they owe and raise requests.
Fleito does not own, rent or maintain the vehicles. Your rental is with your operator, not with Vaya. The operator sets the rent, deposit, charges and rental rules, and is responsible for the vehicle and for its agreement with you.
2. Who can use Fleito
- You must be at least 18 years old and able to enter a contract under Indian law.
- Riders must hold whatever licence or permit the operator and the law require to ride the vehicle.
- Operators must be a business able to enter a contract, and are covered by a separate subscription agreement with Vaya ([OPERATOR SUBSCRIPTION AGREEMENT]). If that agreement and these terms conflict, that agreement wins for the operator.
3. Your account
- Riders sign in with a mobile number and a one-time code. Keep your phone and codes to yourself. Anything done through your account is treated as done by you.
- Give true and current details. If something changes, update it in the app or tell your operator.
- Tell us or your operator straight away if you think someone else is using your account.
4. For riders
Joining an operator. You join an operator by entering the code it gives you. You can be with one operator at a time.
Verification. Your operator asks for identity documents and a selfie, and reviews them. You can ask your operator whether it accepts an alternative to Aadhaar. When you sign your rental agreement, the app checks your Aadhaar number on your phone and only the last 4 digits are kept.
Vehicle inspection. You may be asked to photograph the vehicle at handover and at other times. These photos record the vehicle's condition and may be used if there is a dispute about damage.
Rental agreement. You sign your rental agreement with your operator inside the app. Read it before you sign. You can download a copy of what you signed. If the operator publishes a new version, you may be asked to sign again.
Payments. The amounts you owe (rent, security deposit, and charges such as damage, maintenance or extra battery swaps) are set by your operator under your rental agreement. You can pay through a payment link in the app or in a reminder message, or pay your operator in cash and record it in the app for the operator to approve. A cash payment counts only once your operator approves it.
Ending your rental. You can request to end your rental (deboarding) in the app. You may need to clear what you owe first. Your security deposit is handled as described in our Refund and Cancellation Policy.
5. Payments through Fleito
- Online payments are processed by licensed payment partners (currently Cashfree Payments, and Razorpay for some refunds). Their own terms also apply to your payment.
- We do not see or store your full card, bank or UPI PIN details.
- An amount is shown as paid only once the payment partner confirms it. Your transaction list in the app is the record of what has been paid.
- [PAYMENT COLLECTION MODEL - state who receives the money: Vaya on behalf of the operator, or the operator directly.]
6. Messages we send
To run the service we send sign-in codes, rent reminders, payment updates and other service notices by WhatsApp and app notification. These are part of the service. We do not use them for unrelated advertising without your consent.
7. Fair use
Do not:
- give false information or documents, or use someone else's identity;
- try to get into accounts, data or parts of Fleito you are not allowed to access;
- interfere with Fleito, overload it, or copy or reverse-engineer it except where the law allows;
- use Fleito for anything illegal.
We may suspend an account that breaks these rules, after telling you why where we reasonably can.
8. Vehicle data
Vehicles managed on Fleito may report their location, status and battery details, and battery swap partners may share swap history. Operators use this to manage their fleet. See the Privacy Policy for how this is handled.
9. Our rights in Fleito
Fleito, its software, name and logo belong to Vaya. You get a personal, non-transferable right to use Fleito for its intended purpose while these terms apply. Your own information stays yours.
10. Availability
We work to keep Fleito running and secure, but we cannot promise it will always be available or error-free. We may change or improve features. If a change materially affects operators, we will give notice as their subscription agreement sets out.
11. Responsibility
- Vaya is responsible for providing the Fleito software with reasonable care and skill.
- Vaya is not a party to your rental agreement and is not responsible for the vehicle, its condition, its use on the road, or the operator's decisions about your rental, deposit or charges.
- To the extent the law allows, Vaya is not liable for indirect losses, such as lost earnings or lost business, and Vaya's total liability to a rider for any claim is limited to [LIABILITY CAP FOR RIDERS].
- Nothing in these terms limits any right you have under the Consumer Protection Act, 2019 or other law that cannot be limited by contract.
12. Ending your use
You can stop using Fleito at any time. Your operator may end your access when your rental ends. We may suspend or close an account that breaks these terms or the law. Some records are kept after an account ends, as explained in the Privacy Policy.
13. Changes to these terms
We may update these terms. We will post the new version here with a new effective date and, for important changes, tell you in the app before they apply. If you keep using Fleito after that, the new terms apply.
14. Law and disputes
These terms are governed by the laws of India. Please contact us first so we can try to sort things out. If that does not work, the courts at [GOVERNING-LAW CITY] have jurisdiction, without affecting any right you have to approach a consumer commission.
15. Complaints and grievance officer
Under the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, our grievance officer is:
- Name: [GRIEVANCE OFFICER NAME]
- Designation: [GRIEVANCE OFFICER DESIGNATION]
- Email: [email protected]
- Phone: [SUPPORT PHONE]
- Address: [REGISTERED OFFICE ADDRESS]
We acknowledge complaints within 48 hours and aim to resolve them within one month.
Complaints about your rental itself (rent, deposit, charges, the vehicle) are usually fastest through your operator. If your operator does not resolve it, write to us and we will help where we can.
